Even if it was somehow transit damge its still up to the seller to send an item to you well wrapped & protected. Failure to do so automatically results in a dispute case for me if the seller is non-negotiable. I think theres even a ebay rule somewhere about this. A few times i have recieved a new item but because it wasnt packed well or not packed to my instructions its turned up damaged & so if the seller wont come to an agreement,i open a dispute. The odd time the seller just gave a partial refund which is much easier & cheaper than sending anything back overseas
He's offered to give me a refund of ?79.60 (bizarre, I know, why he wouldn't just round it up to 80) as he claims he won't pay for postage back and is still insisting that it wasn't ripped before he sent it, so is taking some off for that.

I paid ?85 for it, so I'm not sure whether to open a case or just cut my loses, I know I'm definitely correct, but is it worth ?5.40 and what might be a long, drawn out case to get it back? I'm getting the sense he knows I'm not oblivious to what he's done and I'm quite clued up.
