I paid ?85 for it, so I'm not sure whether to open a case or just cut my loses, I know I'm definitely correct, but is it worth ?5.40 and what might be a long, drawn out case to get it back? I'm getting the sense he knows I'm not oblivious to what he's done and I'm quite clued up.

By ebay rules the seller of an item doesnt have to pay return postage, its up to the buyer to cover the cost. This is why its always cheaper & easier if you can negotiate a compromise with the seller of a damaged item. Items dont rip or tear in transit, they only get dented or damaged. You also stated inner packaging wasnt even there,so that wouldnt dissapear in transit, lol. The fact that hes come up with a reasonably good refund fairly quickly means you are right, the seller knows they have screwed up. By the sounds of it your getting the refund & get to keep the item so i think personally, you may not have decent packaging for the item but you still have the item cheap. Do the deal, stay away from the seller & move on. Its not worth the long drawn out hassle thats involved with disputes, they can take months to resolve, its not worth the energy or stress if your getting a partial refund & get to keep the item.
