Well, it would most likely be under a breach of contract or false-advertising type claim, but regardless they obviously felt that someone could sue (or their lawyers did at least) and thus put the non-arbitration (etc.) clause in the TOS for their free game. And its not that someone could win a suit as much as bring one. Both are bad for business.
