Darksiders was a good game in my opinion & does have quite a cult following,more than people realise. I am missing a few things from the Darksiders franchise but not to many. The bunch of Darksiders 2 stuff shown apart from the pen was supposedly given to the media over here before release,all is new/still sealed & cost a measly $70 inc postage Another bargain for me,lol

I've been wanting Xenoblade Chronicles limited edition (with the red controller for a while) and finally found one listed as "new" on Ebay for ?85 the other day and decided to bite, because I've missed out too many times on it stupidly.

Unfortantely, it has turned up far from new =( The box is ripped and dirty and inner packaging molds are missing. None of this was explained in the description, my doom and gloom trying to get this game limited edition continues =(

Seller claiming that it "wasn't ripped when they sent it", but it's clearly not new since the packaging that held the red controller in is missing!

Hopefully I'll get a response tomorrow telling me they'll accept the return.

That's really poor I have wondered about videoing all my package openings as you get to a point where you trust no one...

If all else fails just open an item not as described dispute. The fact you say theres no inner packaging clearly means its not new or as described. The box may get damaged in transit but the inner pckaging didnt disolve into nothing in transit. Even if it was somehow transit damge its still up to the seller to send an item to you well wrapped & protected. Failure to do so automatically results in a dispute case for me if the seller is non-negotiable. I think theres even a ebay rule somewhere about this. A few times i have recieved a new item but because it wasnt packed well or not packed to my instructions its turned up damaged & so if the seller wont come to an agreement,i open a dispute. The odd time the seller just gave a partial refund which is much easier & cheaper than sending anything back overseas

He's offered to give me a refund of ?79.60 (bizarre, I know, why he wouldn't just round it up to 80) as he claims he won't pay for postage back and is still insisting that it wasn't ripped before he sent it, so is taking some off for that.

I paid ?85 for it, so I'm not sure whether to open a case or just cut my loses, I know I'm definitely correct, but is it worth ?5.40 and what might be a long, drawn out case to get it back? I'm getting the sense he knows I'm not oblivious to what he's done and I'm quite clued up.
