The seller is clearing trying to protect himself, they would need evidence of the item condition prior to dispatch. They would also need proof the item was not damaged in transit.

This sounds like a easy case for eBay, whatever you do, don't fall to his levels via the communication the resolution centre. Ensure the seller does all the trash talking.

In certain cases you can escalate the case early if both parties are unable to agree but it's rare. In the end of the day simple say that:


"My only solution to this is a return and refund. No other option is acceptable as the item is not as described. Please let me know your decision so I can request guidance from eBay on the next step.

Many thanks"

Now the onus is on him to make a final decision and eBay can force an escalation early.

that sucks, it actually just happened to me aswell...the seller said i swapped the item and that the one i had wasnt the one he sent, complete dickhead
