Default Grr, eBay.

I'm really not having any luck lately, first, those horrendous customs charges, and now ebay.

I purchased a CE last week. Was apparently in perfect condition, minus a few dings on the window of the box. Okay, no problem. I won the auction (there was pics btw, just none of the box, pictures were all from a distance, but item looked in fairly good condition).

Received the item, and no. The box was entirely caved in, and the item itself was snapped.

He is now accusing me of doing this myself, to get a refund.

Ahem, now why the fuck would I do that!? To an item I wanted!

Grr. Safe to say I shall be escalating the case as soon as my 10 days are up xx

What will likely happen is eBay will ask you to return at your cost for a refund.

The other option is if the seller escalates the case, he will lose the case because ebay protects buyers. The result will be he loses and a refund is given and you still have a damaged item. Which you should return if asked but at his cost.

He's adamant that I've done the damage myself, and I mean, why the hell would I? I bidded, because I want the item, and didn't mind the damage he detailed. When it arrived in a shocking condition, I was gutted to say the least.

He thinks I've damaged it to get a refund as I wasn't happy with the damage already on it.

What the hell?

And also, it couldn't have been damaged in transit as the box he packaged it in was in perfect condition... xx

The seller is clearing trying to protect himself, they would need evidence of the item condition prior to dispatch. They would also need proof the item was not damaged in transit.

This sounds like a easy case for eBay, whatever you do, don't fall to his levels via the communication the resolution centre. Ensure the seller does all the trash talking.

In certain cases you can escalate the case early if both parties are unable to agree but it's rare. In the end of the day simple say that:


"My only solution to this is a return and refund. No other option is acceptable as the item is not as described. Please let me know your decision so I can request guidance from eBay on the next step.

Many thanks"

Now the onus is on him to make a final decision and eBay can force an escalation early.

that sucks, it actually just happened to me aswell...the seller said i swapped the item and that the one i had wasnt the one he sent, complete dickhead

Yeah, he's been filling all of his messages with lots of question marks and his messages seem quite snappy and defensive (although thats my opinion, online messages are hard to read without changing the tone they were meant in!).
I've been replying very simply, never snapping, etc.
Hopefully eBay sorts it out quickly. It's really doing my head in, especially as he moaned as I hadn't sent him pictures within a day. I apologised and said sorry I've been very busy. I left out that I was busy with my son incase he blamed it on him (he previously blamed it on me as I mentioned I'm a collector, but don't mind small damage to items, as long as it is just to the box (as he described in his listing) and he turned it on me saying "well if you're a collector then you should only buy brand new as it's not fair that my item wasn't up to your standards" or something along those lines) xx

Yeah, these type of sellers piss me off....im pissed off just hearing this, dont let them get away with it

I won the case, got my money refunded (including P&P) and eBay let me keep the item, ah. My faith in eBay has been restored ever so slightly.

Bet the guy is fucking raging though xx

Thats a courtesy refund i think from Paypal, i had a similar dispute recently but this PUNK had the cheek to send me a feedback revision request errr Fuck Off

haha i haven't even left the guy feedback yet haha, wanted to leave it until i had escalated the case incase he decided to be nice and refund me himself, then he'd have gotten himself some neutral feedback, but now he's getting a big fat negative xx
