PS3 Dead Space 2 CE: Deal?

I found someone selling it brand new, but the outer box is opened. Everything inside is pristine and still sealed. I can get it for around $40.

How does that price sound?

I think Best Buy had been selling them for $5.99 recently. May be they still do. Or may be that was just PC, I dont remember now.

Looks like they were selling them for $9 for the Xbox 360 and PS3 and $6 for the PC. Not anymore though.

Does the fact that that deal existed knock the value down even though it isn't around anymore? It looks like they're $70-80 everywhere now.

I'm not looking to play it myself, I'm just trying to figure if the deal I talked above is worth it or not.
